Lendfax Media, LLC, doing business as LendFax (“LendFax,” “we,” “us,” or “our”), respects your privacy. We have sold or shared Personal Information in the preceding 12 months to personalize your website experience and to deliver content and product and service offerings relevant to your interests, including targeted offers and ads through our website, third-party sites, and via email or text message (with your consent, where required by law). We do not knowingly share or sell the Personal Information of anyone under the age of 16. We use Sensitive Personal Information (i.e., Social Security) only for purposes expressly permitted under California law.)

5. Your Consent to Communications (TCPA & CAN-SPAM)

By checking the consent box and submitting a form, you authorize LendFax and its partners to contact you via:
  • Autodialed or pre-recorded/artificial voice calls
  • SMS/MMS messages
  • Emails
Message/data rates may apply. Consent is not a condition of service. You can opt out at any time by clicking unsubscribe in emails or replying STOP to texts.

6. Your Rights and Choices (CCPA/CPRA & State Laws)

We use cookies and tracking technologies including Meta Pixel and Google Analytics to:

  • Access a copy of the data we hold on you
  • Request deletion of your personal information
  • Opt out of the sale or sharing of your personal information
  • Correct inaccurate information
  • Limit the use of sensitive personal data

You can submit a request by emailing info@lendfax.com or completing our Data Request form. We will verify your identity and respond within 45 days. If we require additional time to process your request, up to a maximum total of ninety (90) days from the date the request is received, we will notify you of this and inform you of the reason for requiring the additional time.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period.

The verifiable consumer request must:

  • Provide sufficient information that allows LendFax to verify, to a reasonable degree of certainty, that you are the person about whom LendFax collected personal information (or your authorized representative), which may include multi-factor authentication of identifying information provided by you. Such authentication may be conducted and verified independently or in combination with a comparison of personal information already maintained by LendFax, if any; and
  • Describe your request with sufficient detail that allows LendFax to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm that the personal information relates to you. Making a verifiable consumer request does not require you to create an account with us, but we must also be able to confirm the personal information relates to you. However, we do consider requests made through your password protected account sufficiently verified when the request relates to personal information associated with that specific account.
We will only use personal information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Non-Discrimination: We will not discriminate against you for exercising any of your rights as described above. Unless permitted by the law, LendFax will not:
  • Deny you goods or services.
  • Charge you different prices or rates for goods or services, including through granting discounts or other benefits, or imposing penalties.
  • Provide you a different level or quality of goods or services.
  • Suggest that you may receive a different price or rate for goods or services or a different level or quality of goods or services.

7. Use of Cookies and Online Tracking

We use cookies and tracking technologies including Meta Pixel and Google Analytics to:

  • Understand how visitors use our sites
  • Retarget visitors with relevant ads
  • Measure ad performance

You can manage cookie preferences through your browser or device settings or by directly updating through our website cookie banner.

8. Data Retention

We retain personal data:

All leads and form submissions are stored and delivered via LeadProsper. Admin access is MFA-protected and restricted to key personnel.

Please be advised that, although we take commercially reasonable technological precautions to protect your data, no data transmission over the Internet can be guaranteed to be 100% secure; therefore, we cannot and do not warrant that your information will be absolutely secure.

10. No Services for Minors

We do not knowingly collect data from individuals under 18. If you believe a minor has submitted information, contact us immediately.

11. Third-Party Websites

Our site may contain links to third-party sites. We are not responsible for their privacy practices.

12. Changes to This Policy

We may update this Privacy Policy periodically. Material changes will be posted on our website with the new effective date.
